Australia - Family Visa
The Family Visa allows you to live and migrate from one country to another with all of your family members. The presence of one or more family members in a particular country allows the rest of the family to immigrate there as well. Over 60,000 visas are granted each year by Australia’s immigration system to family members of Australian citizens, permanent residents, and New Zealand nationals. The “Family Stream” program is responsible for family visas.
Family Stream migration is divided into three categories:
- Spouse / Partner
- Child
- Parent
Spouse - Partner Visa
Spousal immigration is a type of family reunion or marriage immigration in which one spouse immigrates to the country of the other spouse. A partner visa requires you to provide proof that your relationship is real and long-term, and that you intend to live together permanently. Partner visas, both temporary and permanent, require only one application. A temporary visa is required for a permanent resident to go from home to abroad (Australia).

If your family have Permanent Residency or Citizenship, all you need to file the application is a sponsorship letter from your relative / blood related, along with other prerequisites. As a result, the sponsorship letter facilitates the execution of the family immigration process.
Spouse Visa Requirement
To be eligible for a spouse visa to Australia, you must meet the following criteria:
- You and your spouse live together or do not live apart on a permanent basis.
- Your relationship is genuine and lasting.
- Unless legally married, you must have been in a spouse relationship for the previous 12 months, which usually means showing that you lived together during this time.
- You must both be at least 18 years old.
- You must meet health and character requirements.
Spouse Visa Procedure
When applying for a spouse visa for Australia, you might be in Australia or abroad, although there are advantages to applying from within Australia. Please contact us if you need help obtaining a spouse visa.
You will be issued an Extended Eligibility Temporary Visa once your initial application is approved. This will allow you to stay in Australia for two years and work freely during that time.
In some circumstances before applying for permanent residence it is not necessary to wait for two years this could happen if:
- You have been married to your spouse for at least five years at the time of application.
- You've been in a relationship for two years with dependent children.
- Your spouse received a permanent visa under the humanitarian program or a protection visa and was in a relationship with you prior to the visa's issuance, and this relationship was declared to Australian immigration officials at the time.
After the two-year period, you will be eligible to apply for permanent residency in Australia provided that your relationship still continues.
In rare cases, you may be eligible for permanent residence even though your relationship ended before the two-year period ended. Some of these circumstances are:
- If your spouse died during this time period.
- If you and your Australian spouse have children under the age of 18.
- If you or your dependents have experienced domestic violence during this time period.
Child Visa
Families with dependent children are invited to join them in Australia at any time. Children may travel to Australia with their parents, but they may also migrate alone.
Children under the age of 18 can also obtain visas. They could be biological children, orphan relatives, or adopted offspring of Australians, permanent residents, or New Zealanders. These children can apply for permanent residence visas and live continuously in Australia before becoming citizens.
Understand your visa type:
A Subclass 802- Child visa allows an eligible parent to sponsor their child’s indefinite stay in Australia. A parent may apply on behalf of a child under the age of 18.
An eligible parent is one of the following:
- an Australian citizen
- an Australian permanent residence visa holder
When the application is made and when it is decided, the child must be in Australia
What You Can Achieve With This Visa
- Stay in Australia indefinitely
- Work and study there
- Enroll in Medicare, Australia's health-care insurance program.
- Apply for citizenship in Australia (if eligible)
- Sponsor eligible relatives for permanent residency
- They can travel to and from Australia for five years from the date the visa is granted; after that, they will require another visa to enter the country.
Before you apply
If at least one parent is an Australian citizen or a holder of an Australian permanent residence visa, children born in Australia are immediately granted Australian citizenship. They do not require a visa in order to live in Australia.
Children born outside of Australia must:
- Apply for a permanent visa to live in Australia (if neither parent is a citizen of Australia), or
- Apply for Australian citizenship (if at least one parent is a citizen of Australia).
No further stay requirements
If you already have another visa with a ‘No further stay’ condition, you cannot apply for this one.

Parental Visa
Parent visas are divided into two categories: Aged Parent (Residence) (Subclass 804) and Parent (Migrant) (Subclass 103).
Parental Visa Requirement:
To apply for a parent migrant visa, you must also meet the standards listed below.
Applicants for aged parent visas must have an Australian citizen or permanent resident child or stepchild. Further requirements include:
- At least half of your children are Australian citizens or permanent residents.
- Australia has a higher proportion of children who are Australian citizens or permanent residents.
